End User License Agreement (EULA)

Subject to your compliance with this EULA, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Application on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions
• Use the Application for your personal, non-commercial purposes

The Application is licensed, not sold. This license is for your personal, non-commercial use only.

StackEdge is a poker bankroll tracking, session logging, and analytics application. The Application allows users to log poker sessions, track financial results, analyze performance statistics, manage bankroll records, and organize poker-related notes and data.

StackEdge is a personal record-keeping and analytics tool only. StackEdge is not a gambling platform. StackEdge does not host poker games, offer betting, process wagers, accept deposits, issue withdrawals, sell gambling credits, or facilitate real-money gambling transactions of any kind. All poker results, financial figures, session records, and notes are entered by the user for personal tracking purposes only.

You may not:

• Copy, modify, adapt, translate, or create derivative works of the Application
• Distribute, sell, sublicense, rent, lease, lend, transfer, or make the Application available to any third party
• Reverse engineer, disassemble, decompile, or attempt to derive the source code of the Application, except to the extent permitted by applicable law
• Remove, alter, or obscure any copyright, trademark, or proprietary notices from the Application
• Use the Application for any unlawful purpose or in violation of applicable laws or regulations
• Use the Application to facilitate illegal gambling, betting, wagering, fraud, or any unlawful financial activity
• Interfere with or disrupt the operation, security, or integrity of the Application or its related services
• Use automated scripts, bots, scraping tools, or similar methods to access or interact with the Application without written permission

The Application, including its software, design, features, graphics, logos, text, icons, and related materials, is owned by Licensor and is protected by intellectual property and other applicable laws. This EULA does not transfer ownership of the Application to you. All rights not expressly granted in this EULA are reserved by Licensor.

StackEdge offers free features and paid premium features.

Premium Subscription: Access to premium features may require an active paid subscription, such as StackEdge Premium Monthly or StackEdge Premium Annual, purchased through Apple In-App Purchase.

Billing: Subscriptions are billed through your Apple ID account and are managed by Apple. Subscription prices, durations, free trials, and renewal terms are displayed in the Application before purchase.

Auto-Renewal: Auto-renewable subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account may be charged for renewal within 24 hours before the end of the current billing period.

Cancellation: You may manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Refunds, if any, are handled by Apple in accordance with Apple's policies and applicable law.

You retain ownership of all data you enter into the Application, including session records, bankroll entries, hand notes, venue information, and related user-generated content. By using the Application, you grant Licensor a limited license to store, process, transmit, and display your data solely as necessary to provide, maintain, secure, and improve the Application. The Application may use third-party services, including Apple, Firebase/Google, RevenueCat, analytics providers, crash reporting tools, and other service providers necessary to operate the Application. Your use of the Application may also be subject to applicable third-party terms and policies. Licensor is not responsible for the services, policies, or practices of third-party providers.

Licensor may update, modify, add, or remove features from the Application at any time. Updates may be required for continued use of the Application. Your continued use of the Application after an update or change constitutes your acceptance of the updated Application and any applicable updated terms.

This EULA remains effective until terminated by you or Licensor. You may terminate this EULA by deleting the Application and ceasing all use of the Application.

Licensor may suspend or terminate your access to the Application if you violate this EULA, misuse the Application, violate applicable law, or engage in conduct that may harm Licensor, other users, or the integrity of the Application.

Upon termination, you must stop using the Application and delete all copies in your possession or control.

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.

STACKEDGE DOES NOT PROVIDE FINANCIAL, LEGAL, TAX, GAMBLING, OR INVESTMENT ADVICE. ALL ANALYTICS, STATISTICS, BANKROLL INFORMATION, SESSION RESULTS, AND RELATED INSIGHTS ARE PROVIDED FOR INFORMATIONAL AND RECORD-KEEPING PURPOSES ONLY. YOU ARE SOLELY RESPONSIBLE FOR YOUR OWN DECISIONS AND COMPLIANCE WITH APPLICABLE LAWS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, INTERRUPTION OF SERVICE, APP ERRORS, DATA INACCURACIES, OR DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE APPLICATION. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE APPLICATION OR THIS EULA SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION OR SUBSCRIPTION IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless Licensor from and against any claims, liabilities, damages, losses, costs, expenses, or fees, including reasonable attorneys' fees, arising out of or related to your use of the Application, your violation of this EULA, your violation of applicable law, or your violation of any third-party rights.

You represent and warrant that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with all applicable local, state, national, and international laws and regulations when using the Application.

This EULA is governed by the laws of the State of Arizona, without regard to conflict of law principles, except to the extent such law is preempted by applicable federal law or mandatory consumer protection laws in your jurisdiction.

This EULA is a legal agreement between you and Licensor only, and not with Apple. Licensor, not Apple, is solely responsible for the Application and its content.

Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Application.

In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application, if any. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Application.

Apple is not responsible for addressing any claims by you or any third party relating to the Application or your possession or use of the Application, including: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property infringement claim related to the Application or your possession or use of the Application.

You must comply with applicable third-party terms of agreement when using the Application.

Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right, and will be deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.
